The following rules and regulations have been adopted and will be administered by Key Club Associates, Limited Partnership, the Owner of Longboat Key Club & Resort, the Club. The Club is a privately owned and operated golf and tennis resort, located on Longboat Key, Florida. In adopting these rules and regulations it is the intent of the Owner that the membership and guests will obtain maximum use and enjoyment of the Club facilities. Enforcement of these rules and regulations will be placed in the hands of a carefully selected staff whose principal responsibility is to assure all courtesies, comforts and services are received by the membership. The rules and regulations are designed to define the rights and privileges of Members of the Club, their families and guests, and to protect Club property. It is the duty of those using the Club to know the rules and regulations and to cooperate with the Owner and its staff in the enforcement thereof.
I. Membership Rules
Section 1. Current membership categories, respective use privileges and fees are provided in a separate tariff schedule.
Section 2. Membership in the Club
a. Is an annual license to use Longboat Key Club & Resort facilities owned by Key Club Associates, Limited Partnership, the Owner. This license is renewable on an annual basis and may not be transferred to another party unless specifically allowed by these rules.
b. Does not create or convey any legal or equitable property interest of any kind, nature, right or description whatsoever, in either the Club, Club facilities, or Key Club Associates, Limited Partnership.
c. Is not an investment in Longboat Key Club & Resort.
d. Is subject to all rules and regulations of the Club.
Section 3. Ownership and Operation of Longboat Key Club & Resort and Club facilities:
a. Club and all Club facilities and property are solely the property of Key Club Associates, Limited Partnership.
Members receive no ownership interest in the Club or any Club facilities or property.
b. The exclusive operation of the Club, its facilities and property is solely the right of the Owner and its designees.
c. The Owner has the sole and exclusive right to alter, change, and/or revise the rules and regulations of membership; to change the Club facilities; to create two (2) new and separate Clubs; to change prices charged for membership to the Club for Club facility use; and exercise any and all other rights of ownership, including the right of sale of the Club or any portion thereof to others.
Section 4. All applications are subject to approval by the Owner. No application will be accepted that has been altered, changed or amended or which has had language deleted. Residents of Islandside (Longboat Key GPD) and Harbourside (Bay Isles PD) PUD’s will receive priority for admission to membership. Applications for golf and tennis memberships may be placed on a waiting list until a membership category is opened at the sole discretion of the Owner. The Owner does not warrant or represent a maximum or minimum total number of memberships in any category. Applicants wishing to remain on the waiting list are required to maintain at minimum a Social membership in order to be eligible for admission to another membership category. Upon acceptance for a Full, Golf, or Tennis membership category, the full Initiation Fee and pro-rated dues for the remainder of the initial year are payable within ten (10) days of receipt of billing. If payment is not received within this period, the membership will be canceled.
Section 5. The Initiation Fee is a one-time, non-refundable, non-transferable charge set by the Owner. This fee is applicable to all new Members and, in some instances, transfers of membership from one category to another. The payment of an Initiation Fee does not convey any ownership rights in the Club or Club facilities. Initiation fees for new membership may be changed by the Owner at any time without notice.
Section 6. Subject to the terms and provisions contained in the membership renewal form, each Member will be allowed to apply for renewal of membership annually.
Section 7. The membership year commences October 1 and expires September 30 of each year. Annual dues are payable in advance prior to October 1 of each year and will not be pro-rated for any portion of a membership year, exception being the initial year of joining the Club. Dues and Initiation fees are neither transferable nor refundable, and are subject to change by the Owner without notice. Initiation fees and membership dues are subject to Florida State sales tax.
Section 8. All existing Members desiring to continue their memberships shall apply to renew their memberships prior to October 1 of each year. Those Members failing to do so will be considered canceled. Membership renewals will not be extended to Members who have failed to pay their account promptly during the Club’s fiscal year. In the event a membership is canceled, the canceled Member shall not be entitled to a refund of the Initiation Fee paid, or any portion thereof.
Section 9. Family membership includes husband, wife and unmarried children under the age of 21 residing with the parent(s). Membership Cards will be issued to each Member entitled to Club privileges. This card is to be carried at all times while on Club property and must be presented prior to use of the Club facilities. Under no circumstances may a Member allow his/her card to be used by a non-Member or a Member possessing a different type of membership. Membership cards will not be issued to children under 13 years of age unless requested by the parent(s). Loss of a card should be reported to the Membership Office at which time a replacement card will be issued for a fee. The Owner reserves the right to limit the amount charged to any individual card.
Section 10. The Club encourages Members to invite guests, subject to the following criteria: the same individual guest will be permitted to utilize golf, tennis and fitness facilities only six (6) times during the membership year beginning October 1 and ending September 30. Guest’s tariff shall be the prevailing guest fee. Member guests must be accompanied by the member. Under no circumstances will a guest use any Club Member’s card. The Member shall be responsible for the conduct of each of his or her guests while at the Club, for payment of any guest fees as may be prescribed by the Owner, and for payment of any charges incurred by the guests. The Owner or management personnel employed by the Club may deny guest privileges to any individual when, in their opinion, it is in the best interest of the Club to do so.
Section 11. Club accounts are due and payable within ten (10) days after billing. The Owner may charge interest on any amounts remaining unpaid thirty (30) days after the billing date at the rate of eighteen percent (18%) per annum. Each applicant shall execute the truth in lending disclosure form supplied by the Owner as part of the application for membership. If a Member’s account remains unpaid for thirty (30) days or more, the Member’s facilities use privileges will be subject to suspension. Repeated failure to keep accounts current shall result in cancellation of the membership and forfeiture of Initiation Fee. It is the responsibility of the Member to retain a receipt for purchases. Copies of charges are not included in the monthly billing statement, nor will receipts be sent to Members unless a charge is disputed.
Section 12. Arrangements for meeting facilities must be made through Management and with the express authorization of the Owner. Charges, if any, for these facilities will be determined at time of arrangement.
Section 13. Any Member found abusing any Club facilities, interfering in Club operations, disturbing other Members and their guests or violating Club rules is subject to membership suspension or termination with total forfeiture of paid dues and Initiation Fee at the sole discretion of the Owner.
Section 14. The use of Club facilities is at the user’s own risk. The Club is not responsible for injuries. Individuals with heart or other health disorders should not use the course, courts or Fitness Centre, or Mind & Motion Studio without consulting their physicians prior to use.
Section 15. Repeated violation of Club rules and regulations; displaying of temper or other discourteous conduct resulting in damage to Club property; disrespect shown to the Owner, Club employees, Members and guests; failure to register guests or failure to keep accounts current shall result in the termination of Member’s use rights with forfeiture of Initiation Fee.
Section 16. The Owner shall have the exclusive right to amend, modify, or supplement these rules and regulations during the course of the membership year. The Owner shall post any amendments, modifications or supplements hereto prominently about the Club. The Owner shall publish the rules and regulations as modified. Unless terminated by the Owner, these rules and regulations shall be of unlimited duration.
Section 17. By making application for membership, each Member expressly consents and agrees to take membership subject to these rules and regulations and agrees to be bound by all provisions hereof, as amended, modified or supplemented from time to time. Member’s sole remedy in the event a Member disagrees with a provision of the rules and regulations is to terminate the membership.
Section 18. The failure of the Owner to insist upon strict adherence to and of the rules and regulations by the Members and guests shall not be deemed a waiver by the Owner of any subsequent violations of any Club rules or regulations by any Member or guest.
Section 19. Any Member, whose membership is terminated pursuant to these rules and regulations or whose membership is canceled due to failure to renew, reapplying for membership at a later time shall be subject, upon acceptance, to the then applicable Initiation Fee.
II. General Club Rules
Section 1. The comfort and convenience of all Members and Guests will best be served by strict observance of all Club rules and regulations. Members are requested to report any violations of the rules to Management or the Owner.
Section 2. A service charge will be added to all food and beverage charges.
Additional gratuities remain at the discretion of the individual Member.
Section 3. Members are required to park automobiles and bicycles in the designated parking area; to refrain from parking in unloading zones, driveways, roadways, grassy areas or emergency lanes and to carefully observe speed regulations in the Club grounds (15 miles per hour). Improperly parked vehicles will be towed at the vehicle owner’s expense.
Section 4. The only form of payment accepted for merchandise and service at the Club outlets will be your membership card. No cash or credit cards will be accepted. Annual dues and monthly statements may be paid by credit card upon completion of an authorization form.
Section 5. Employees are instructed not to sign charge tickets for any Member. Membership cards must be presented for all charges and may be used only by the Member named on the face of the card. Membership cards remain the property of the Owner and must be returned upon demand.
Section 6. Members are responsible for any damage or breakage they or their guests may cause.
Section 7. The Owner is licensed by the State of Florida Department of Business Regulation to serve alcoholic beverages on the Club premises. It is unlawful for any person to bring or consume alcoholic beverages not purchased from the Club on Club property. The sale of alcoholic beverages shall be in accordance with State and Federal regulations. The service of alcoholic beverages to any individual at any time will be at the sole discretion of the Owner and management. No one under 21 years old will be served alcoholic beverages under any circumstances. The consumption of personal food items not purchased from Longboat Key Club & Resort will not be allowed in any food and beverage area.
Section 8. The Club or the Owner shall not be responsible for the loss of, or damage to property of Members or guests, or for any other loss or damage sustained by Members or their guests in the Clubhouses, on the Club premises or in the Resort at Longboat Key Club & Resort.
Section 9. No Member shall mutilate or take from the Club any article belonging to the Club, the Owner, Management or other Member or guest.
Section 10. Domestic animals and pets will not be permitted anywhere on Club or Resort property.
Section 11. Papers, handbills, posters, subscription papers or solicitation of any kind will not be allowed on Club property and no advertising may be posted on Club property except by permission of the Owner.
Section 12. Members shall be respectful of Club employees and shall not reprimand any Club employee, interfere with management of the Club or instruct any employee to act contrary to policies and procedures of the Owner. Complaints regarding specific employees should be reported to the Management in writing. Loud and abusive language or behavior will not be permitted.
Section 13. Members will not interfere in Club operations or disturb other Members or prevent Member’s guests or guests of the Owners from quiet and full enjoyment of Club facilities. All records of the Club, including membership lists and rosters, are the sole property of the Owner and are not to be distributed without written authorization by the Owner. Use of such lists and rosters, other than for member's personal use, may result in penalty including termination of Club membership.
Section 14. Members may be requested to provide identification other than a Club membership card to identify themselves to Club employees before using or during the use of Club facilities. Anyone that refuses identification will be asked to leave the Owner’s property.
Section 15. The name “Longboat Key Club & Resort” as it applies to Club facilities is the sole property of the Owner and shall not be used by anyone without the expressed written consent of the Owner. Club stationery will not be utilized for correspondence without the expressed written consent of the Owner.
Section 16. Gambling of any form on Longboat Key Club & Resort property is strictly prohibited at all times.
Section 17.Social members are permitted to play golf or tennis, at the prevailing Social greens rate, twenty-four (24) times per membership year limited to May 1 through November 30. From December 1 to April 30, golf is permitted up to twelve (12) times at prevailing Social greens rate. Cart fees apply. A tee or court time may not be reserved more than 2 days in advance and is subordinate to the privileges of Full and Golf Members.
Section 18. Tennis Members are permitted to play golf limited by the requirements as explained in Section 17.
Section 19. Any Member or Member’s guest renting and/or operating a golf cart will be solely responsible for any personal injury or damage to persons or property, including the cart. Upon acceptance of these rules and regulations, individual agrees to hold harmless the Club and its Owners for personal injury or property damage. Improper use of golf cart will subject the individual Member to suspension or termination of membership at the sole discretion of the Owner.
Section 20. Absolutely no one who is not actually “playing a round of golf” will be allowed on the golf course. Jogging, walking, bicycling or searching for golf balls on the course is not permitted at any time.
Section 21. Members are kindly asked to refrain from using cellular phones in all of the Club restaurants, the spa, and in the Fitness Centre.
Section 22. In the event a Club Membership of any class is held by a married couple and the couple is subsequently legally separated or divorced, all rights, benefits, and obligations of the Club Membership must be awarded to one (1) spouse as set forth in the separation agreement or divorce decree. The membership in any class is not divisible. In the absence of a written separation agreement or divorce decree, the membership shall continue in the name of the primary Member set forth on the membership application or renewal form. The spouse may apply for membership in the same manner as any new applicant for membership. During the pending divorce or separation, the Owner, in its sole discretion, can suspend charging privileges of the Member, Member’s spouse, designees and family Members.
Section 23. Members may elect to either upgrade or downgrade their membership status. In the case of an upgrade, Members will be required to pay the difference between the current Initiation Fees plus applicable sales tax of the membership class to which they currently belong and the current Initiation Fees plus applicable sales tax of the class of membership to which they wish to upgrade. If the change is made after the initial renewal date of October 1, Members will be responsible for any pro-rated portion of the membership dues and food and beverage minimum requirements for the new class of membership.
Section 24. In the case of a downgrade in membership status, no credit will be given for Initiation Fees or dues paid for the former class of membership. In the case of death of a spouse resulting in the need to downgrade from Family to Single membership, a net, pro-rated credit will be issued to the member account. At no time will this credit be issued in the form of a cash refund. This credit will reflect the difference between the dues paid for the former class of membership and the dues for the new class of membership through the end of the membership year. Once a membership has been downgraded, applicable Initiation Fees will once again be payable according to the procedures for upgrading a membership under Section 23.
Section 25. In the case of illness or injury, a medical leave of absence may be taken for a period of twelve (12) months. A medical leave of absence will be granted one time over the course of a membership for each adult listed on the membership account as documented on the membership application. Medical leaves of absence do not apply to qualifying children. Medical leave of absence will begin upon receipt of written documentation from a physician. A net, pro-rated credit for the difference in dues will be credited to the member account. At no time will this credit be issued in the form of a cash refund. During the medical leave of absence, a Social membership must be maintained and all applicable dues and food and beverage minimums will apply. At the end of the 12 month leave of absence, the Member must either return to the class of membership held prior to the leave of absence, permanently downgrade to another class of membership as described in Section 24 or cancel the membership.
Section 26. Any Member in good standing for at least five years who reaches the age of 90 shall become an Honorary Member. The Member is responsible for notifying the Club prior to the October 1 renewal date of the impending qualifying birthday. Written verification in the form of a driver’s license or other valid identification is required. The honorary membership will be granted for the membership class held by the Member at the time of the qualifying renewal date. Honorary Members will not be required to pay dues or meet food and beverage minimum requirements for the remainder of their membership tenure.
Section 27. Social or Tennis member may not be a guest of a Golf or Full member to obtain more golf usage/privileges. Social and Tennis members will pay the prevailing golf and cart fee per round of golf as according to specific membership category.
III.Golf
Section 1: Bag Storage
1. Because of limited bag storage, no pull carts or bags of any type with attached wheels will be stored at the Club. Bag storage is available on a complimentary basis to any Full Member desiring this service. Under this agreement, the Owner, the Club or its Management is not responsible for any loss or damage incurred. Claims for loss or damage must be filed with your own insurance company.
2. For Full Member’s convenience, club storage and cleaning is provided annually. Clubs will be cleaned after each use, bag tags will be placed on each bag.
Section 2: Dress Code
Golfers must wear appropriate attire. Soft spike or spikeless shoes will be required of all Members and guests without exception. Shorts are permissible for both men and women golfers provided they are in keeping with good taste. Swimwear, short-shorts, blue jeans, cutoff tee shirts, halter tops and mesh shirts will not be permitted. Shirts, blouses or sweaters must be worn at all times. All men’s shirts must have a collar or mock-style collar. The Owner reserves the right to determine the appropriateness of all attire and will refuse play to individuals in violation.
Section 3: Etiquette
1. Golf is a sport in which etiquette is of paramount importance. Conformity to rules and regulations is mandatory if Members and guests are to receive maximum enjoyment from the time they spend on the course. The Rules of Golf of the United States Golf Association together with the Rules of Etiquette of Golf as adopted by the U.S.G.A. shall be the basis for rules of the Club, except when in conflict with local rules or with any of the rules hereinafter adopted.
2. Players are responsible to see that all footprints in bunkers are leveled, all fairway divots are replaced with sand, and ball marks on the greens are properly repaired. Please do not “scuff” your feet on the greens. Players are asked not to climb up the faces of any bunkers around the course. Litter must be placed in waste containers.
Section 4: Golf Carts
1. Electric carts, pull carts, golf bags, player’s chairs or seats are not allowed on the shoulder or surface of the tees, greens or bunkers. Electric carts must be kept a minimum of 30 feet from all greens and are restricted to cart paths where provided.
2. Electric carts will be required for all play on Islandside course on a year-round basis and on Harbourside course November 1 through May 31. Golfers may walk on Harbourside after 1:30 pm, June 1 through October 31. Players riding in carts are responsible for any damage to their cart. Carts are restricted to two riders and two bags and are never to be taken off golf course property. Carts are to be driven only on established cart paths unless otherwise posted by the Starter. Carts must be kept a safe distance from water hazards. No one under 16 years of age will be allowed to drive a cart. Only carts owned by the Club will be allowed on Club property. Any Member or Member’s guest renting and/or operating a golf cart will be solely responsible for any personal injury or damage to persons or property, including the cart. Upon acceptance of these rules and regulations, individual agrees to hold harmless the Club and its Owners for personal injury or property damage. Improper use of golf cart will subject the individual Member to suspension or termination of membership at the sole discretion of the Owner.
Section 5: Golf Lessons and Club Repair
All lessons, club repair and other services will be arranged by the Director of Golf. Lessons not canceled within 24 hours will be subject to full charge.
Section 6: Hours of Operation
Golf pro shop facilities are open seven days a week from 7:00 am until 5:30 pm except for reasons of inclement weather, seasonal fluctuations or other unforeseen circumstances. Hours of operation will be at the sole discretion of the Owner.
Section 7: Lockers
Locker keys are issued to Members renting lockers in the clubhouse. The Owner and its officers and employees are not responsible for lost articles or pilferage from any lockers. Lock your lockers when you leave. If any loss or pilferage is discovered, a claim must be filed with your own insurance company.
Section 8: Practice Areas
Fairways, greens and bunkers on the course are not to be used for practice. Practice will be limited to designated practice areas only.
Section 9: Pro Shop Merchandise
Merchandise purchased in the Longboat Key Club & Resort pro shops may be returned or exchanged within 30 days from the date of purchase, only if the article was not used or worn. A credit, refund or exchange will not be issued without the original sales receipt. The exception is for merchandise that is on sale; sale purchases are considered final.
Section 10: Tee Times
The Harbourside Golf Course is reserved on Tuesday mornings for play by the Women’s Association. The Harbourside course is reserved for play by the Men’s Golf Association on Wednesday mornings. Play for others during these reserved times will be available either at Islandside or after such time as the course is cleared of reserved play. The Owner reserves the right to change these assignments and/or reserved days at any time without prior notice.
Section 11: Course Rules
1. Violations of the rules and regulations should be reported to the pro shop. Authority to enforce the rules and regulations on the golf course has been vested in the Director of Golf.
2. The responsibility of all golfers begins on the first tee and continues through the 18th green on every round. Consideration of others is the most important rule of golf. Primary consideration is to avoid injury or annoyance by striking shots before preceding players are out of range.
3. The Director of Golf and Head Golf Professionals shall have charge of all play on the course and will supervise all starting times. Members and guests are required to follow the instructions of course Rangers and Starters. Those Members and guests that disregard instructions of the Club Rangers and Starters will be asked to leave the course with forfeiture of all fees paid. Continuous disregard will result in suspension or termination of membership with forfeiture of Initiation Fees and membership dues.
4. All golfers, Members and their guests will register with the pro shop before using any Club golf facilities. Golfers are not permitted to “walk-on” the golf course without receiving an authorization from the pro shop.
5. Golfers will start on the #1 tee or as directed by the Starter or pro shop staff. Players will be ready for play in sufficient time to begin at their reserved tee times or their tee time may be reassigned by the Starter.
6. Fivesomes or larger groups playing together are prohibited, unless authorized by the Director of Golf and/or each course’s Head Golf Professional.
7. No singles or twosomes will be permitted to start between foursomes during the hours of heavy play without the permission of the Starter.
8. Single players have no standing on the course at any time.
9. No mulligans permitted on #1 tee or #10 tee.
10. Each individual player must have a set of clubs. Players may only have one ball in play at any one time. Rental clubs are available in the pro shop.
11. Players stopping for lunch after nine holes and wishing to continue must consult with Starter or pro shop. Players wishing to continue play after completing nine holes will have priority on the tenth hole of play.
12. Players looking for a lost ball shall immediately signal the following players to pass through. Once the signal has been given, they shall not continue their play until the players passing through and are out of range, even if the lost ball is found promptly after the signal is given.
13. Whenever a full hole is open in front of a group of players, the slower players must let oncoming faster players through.
14. Retrieving golf balls from the course or Club property is prohibited other than in the normal course of playing golf and retrieving your own ball. The “raking” of golf balls from water hazards is prohibited at any time.
15. Absolutely no one who is not actually “playing a round of golf” will be allowed on the golf course. Jogging, walking, bicycling or searching for golf balls on the course is not permitted at any time.
16. Members and guests are strictly prohibited from entering the bag storage area, golf cart garage, golf course maintenance areas, kitchens or storerooms.
17. The Owner reserves the right to close for reason of bad weather, scheduled functions or maintenance, etc., part of or all of the golf course or its facilities at the sole discretion of the Owner.
18. All golfers should be respectful of private property surrounding the golf course. Under no circumstances shall carts be driven on, or any shot played from, another’s property.
19. CAUTION!! Golf course playing surfaces are subject to forces that may cause hazardous conditions. Unmarked and unseen ground depressions may exist at times and create the possibility of personal injury. Please be advised that use of the golf course is at your own risk and subject to the Waiver of Liability as described in Item VIII. The Member hereby acknowledges responsibility to inform his/her guest(s) of the possible hazard prior to play.
Starting times:
a. Starting times are required daily throughout the year and are subject to availability.
c.-1 Starting times will be reserved on Harbourside from 8:00 am until 9:44 am and 12:30 pm until 2:00 pm subject to change by the Owner without notice.
c.-2 Starting times for Islandside will be reserved from 7:30 am until 5:30 pm. All tee times will be off #1 tee, unless changed by the Director of Golf.
d. Starting times may be reserved three (3) days in advance of the date of play for golf Members, subject to availability.
e. If a reserved tee time is not used and is not canceled at least 24 hour prior to play, the Member account will be charged the 18-hole cart rate for the unused tee time.
IV. Golf Practice Range Rules
Section 1. Practice range balls are not to be removed from the range or utilized for play.
Section 2. Full, Golf, Tennis and Social Members will be permitted to utilize the practice range on a complimentary basis. Usage priority will be given to individuals wishing to practice prior to actual play upon payment of cart fee.
V. Fitness Centre and Mind & Motion Studio Rules
Section 1. Usage of Fitness Centre equipment is complimentary to Longboat Key Club & Resort Members and guests. Please contact the Fitness Centre for the current hourly rates for personal fitness training and applicable aerobic and exercise programs. All sessions will be reserved through the Fitness Centre. Cancellation of any session, class must be received 24 hours prior to your appointment. Failure to cancel on a timely basis will result in full charge to your account for the session.
Section 2. The Fitness Centre is open Monday through Friday from 6:30 am to 8 pm, Saturday from 7:30 am to 6 pm and Sunday from 7:30 am to 4 pm except for seasonal fluctuations or other unforeseen circumstances. Hours of operation will be at the sole discretion of the Management.
The Mind &Motion Studio is open Monday through Friday from 7:30 am to 12:30 pm and Saturday from 8:30 am to 11:30 am. During season, afternoon hours of operation may vary. Please contact the Mind and Motion Studio at 941-383-2080 or the Fitness Centre at 941-387-1656 in regards to these hours or for more information about the fitness classes offered.
Section 3. The following rules were developed in order to ensure your enjoyment and safety while utilizing the Fitness Centre and Mind & Motion Studio.
a. Use of the Fitness Centre and Mind & Motion Studio is restricted to those individuals who have been issued Longboat Key Club & Resort membership cards. Guests of Members are subject to rules as outlined in section 10, membership rules as well as a $15 daily usage fee charged to the hosting member's account.
b. Membership card must be presented prior to use of the facility for identification and liability purposes.
c. Appropriate dress is required at all times. No swimwear, cutoff jeans, belts or street wear. Members must wear a rubber soled athletic shoe.
d. Personal belongings must be secured in lockers in the facility or in the locker rooms.
e. Equipment is to be utilized properly and for the exercise as it is designed. Please do not use it as a resting place between sets preventing others timely access and the opportunity to share the equipment.
f. As a courtesy to others, please utilize spray bottles and towels as provided to wipe down equipment after each use.
g. When completing a set with free weights, do not let them drop to the floor and return them to their proper place. Please put the exercise balls back in their designated places.
h. Please do not enter the workout area until you are ready to begin your session. We also ask that you do not remain in the area after you have completed your cool down period.
i. Use of cardiovascular equipment (elliptical, treadmill, bike, rowing machine, etc.) is limited to 30 minutes per piece of equipment when others are waiting.
j. No one under the age of sixteen (16) may be admitted without a parent or utilizing a Longboat Key Club & Resort personal trainer. Admission will only apply to those children of members as listed on their membership application and holding membership cards.
k. Personal training is available for a fee. A Club Member discount of 20% will apply to personal training fees. Only authorized Longboat Key Club & Resort fitness trainers may be utilized on Longboat Key Club & Resort property. Reservations with our personal trainers will be done in a manner that optimizes maximum usage of the trainers and the scheduling of staff.
l. Merchandise purchased in the Longboat Key Club & Resort Fitness Centre may be returned or exchanged within 30 days from the date of purchase, only if the article was not used or worn. A credit, refund or exchange will not be issued without the original sales receipt. The exception is for merchandise that is on sale; sale purchases are considered final.
m. The Wellness Director shall have charge of all Fitness Centre and Mind & Motion usage and will supervise the scheduling of all sessions. Members that disregard instructions of Management will be asked to leave the facility. Continuous disregard will result in loss of Fitness Centre privileges and/or suspension or termination of membership with forfeiture of Initiation Fees and membership dues.
Section 4. Platinum Fitness Level Membership
a. Platinum Fitness Level classes are designated for Platinum Fitness Level members who have upgraded use of Mind & Motion Studio. Platinum Fitness Level members may attend all class offerings at Mind & Motion Studio without fee and may reserve for class up to 30 days in advance. Designated classes, class descriptions and schedule are available at the Fitness Centre and Mind & Motion Studio and are subject to change.
b. Current Full, Golf, and Tennis members, as well Social as all members who joined the Club after 2007, are considered Platinum Fitness Level members. Social members who joined the club prior to 2007 have the opportunity to upgrade their membership by paying a one-time $2,500 upgrade fee to Platinum Fitness Level members.
c. Members who had both joined the Club prior to 2007, and who choose to downgrade their membership category from Full, Golf, and Tennis members to Social membership, must pay the upgrade fee to maintain their Platinum Fitness Level Membership.
VI. Fitness Centre and Mind & Motion Studio Class Rules
a. Each class participant must sign a fitness waiver form before attending classes.
b. Club membership card must be presented each time you enter the fitness class facility, and a sign in sheet completed for each class.
c. Water dispenser is available for class attendees. Water bottles are available for sale in the retail area, or class participants may bring their own. Food is not permitted in the fitness class area.
d. Closed toe athletic foot wear is strongly recommended.
e. Once a class has begun, no late entry will be permitted.
f. No outside activity is permitted in fitness class space while classes are in session.
VII. Island House Spa
a. Arrival time: For your enhanced comfort and relaxation, we suggest that you arrive 30-minutes prior to your scheduled treatment time. Give yourself plenty of time to unwind in our relaxation room, or take a short steam and shower. Muscles that are warm and relaxed receive the maximum benefit from bodywork. Arriving late will limit the time for your treatment.
b. Special Needs: Should you have special considerations or concerns, please notify our Spa Reservationists before booking your treatment. Let us know if you have high blood pressure, allergies, physical ailments or disabilities, if you are pregnant, or using Retin A, Accutane, or Renova.
c. Proper Attire: Most treatments are enjoyed without clothing. During all treatments, the body is fully draped, only exposing the area being worked on. Before and after your treatment, robes and slippers are provided in the men’s and women’s locker rooms.
d. Cancellation Policy: Your appointment is reserved especially for you. Should it become necessary to cancel your appointment, please do so promptly. A 24-hour cancellation is required to avoid a 50% cancellation fee. Appointments for groups of 3 persons or more require cancellation notification 48-hours prior to the first scheduled appointment to avoid being charged a full cancellation penalty.
e. Gratuities: Gratuities are not automatically included in your check at the Spa. Gratuities are a matter of personal discretion. Gratuities reflect your level of satisfaction with our services, and are customarily between 18% and 22%.
f. Pregnancy: While there are a few services that should be avoided during pregnancy, there are many beneficial treatments that can be enjoyed. Please notify our Spa Reservationists if you are pregnant when you make your appointments so that they may offer guidance.
g. Cell Phone Free Zone: Cell phones are not permitted in the Spa. We ask all spa patrons to be mindful of disrupting the relaxation of others.
h. Relaxation Room: Only spa patrons are permitted to use the relaxation room and its amenities.
i. Alcoholic Beverages: Massage increases circulation and the release of toxins that need to be processed by the liver. Drinking alcohol before a massage may overwhelm the liver and cause dangerous levels of intoxication.
j. Spa Products & Merchandise: Merchandise purchased in the Longboat Key Club & Resort shops may be returned or exchanged within 30 days from the date of purchase, only if the article or product was not used or worn. A credit, refund or exchange will not be issued without the original sales receipt. The exception is for merchandise that is on sale; sale purchases are considered final.
VIII. Tennis Rules
Section 1. Maximum courtesy is to be given to all players at all times. The CODE (Revised 1985), as published by the United States Tennis Association, shall govern play except when in conflict with any of the rules adopted hereinafter.
a. Conduct must be exemplary.
b. When retrieving a ball from another court, please wait until points are over prior to asking players to get your ball. A customary “thank you” is always welcome.
c. Doubles will have priority over singles between the hours of 9 am - 12 pm.
d. Players who have yet to play will have priority over those who have already played on a given day.
e. To maximize court availability, playing time will be limited to one and one-half hours.
f. When a tennis court net is lowered, it indicates the court is under repair. Walking or playing on a court at this time is prohibited.
g. Please use the entrance nearest your court. Do not cross one court to get to another. Do not interfere with play in progress.
h. Courts are not to be used for any purpose other than tennis.
i. Only players are allowed on the courts. All children under 12 must be accompanied by an adult who is not playing.
j. Playing guests must be accompanied by a Member.
k. Use of basketball court and ball machines will be at the sole discretion of the Director of Tennis.
Section 2. The Director of Tennis shall have charge of all play on the courts and will supervise all playing time. Members and guests are required to follow the instructions of Management in regard to tennis facility utilization. Members and guests that disregard instructions of Management will be asked to leave the courts with forfeiture of all fees paid. Continuous disregard will result in suspension or termination of membership with forfeiture of Initiation Fees and membership dues.
Section 3. Advance court reservations are required daily throughout the year and are subject to availability.
a. Court time may be reserved by phoning 387-1635.
b. Court times should be canceled 24 hours in advance.
c. Court times may be reserved three (3) days in advance of the date of play for Annual Tennis Members.
d. Reservations for night play must be made prior to 4 pm on the day of play.
Section 4. Tennis courts will be assigned according to the amount of play experienced on each court. Requests for a specific court will be considered, but may not be possible or available due to amount of previous play or unscheduled maintenance work.
Section 5. All players must register in the pro shop, present membership card and pay applicable guest fees before proceeding to a court. Players using courts after normal pro shop hours must register prior to pro shop closing.
Section 6. The pro shop will be open from 8 am until 5 pm daily except for reasons of inclement weather, seasonal fluctuations, or unforeseen circumstances. Hours of operation will be at the sole discretion of the Owner.
a. Merchandise purchased in the Longboat Key Club & Resort pro shops may be returned or exchanged within 30 days of the date of purchase only if the article has not been used or worn. A credit, refund or exchange will not be issued without the original sales receipt. The exception is for merchandise that is on sale; sale purchases are considered final.
b. All lessons with the staff will be arranged through the pro shop as well as racquet stringing, grips and other services. Lessons not canceled within 24 hours will be subject to full charge.
Section 7. The Owner reserves the right to close for reasons of inclement weather, special events or maintenance, etc., part or all of its tennis facilities at the sole discretion of the Owner.
Section 8. Tennis attire only will be permitted on the courts. No swimwear, cutoffs, gym shorts, street pants or Bermuda shorts. Appropriate tennis footwear is required—no basketball shoes, track shoes, cross training shoes, etc. The Owner reserves the right to determine appropriateness of attire and will refuse play to individuals in violation.
IX. Food and Beverage Minimum Spending Requirement
Section 1. All memberships are subject to a minimum food and beverage spending requirement per membership year beginning October 1 and ending September 30. In the event of cancellation or termination of membership, the unused food and beverage minimum spending requirement will not be prorated for any portion of the membership year. Food and beverage minimum spending requirements are provided in a separate tariff schedule.
Section 2: Your monthly billing statement will reflect a balance regarding your food and beverage expenditures and the requirement does not include Florida State sales tax or service charges.
Section 3: Payment for food and beverage charges at designated group member events and club catering will apply to the minimum.
Section 4: Food and Beverage Minimum Policy is as follows:
a. Outlets: All Food and Beverage purchased at any outlets, and in-person, including The Grille Window, The Green House, Spike & Tee’s, The Grille Room, Sands Pointe Restaurant, The Pointe Lounge, Barefoot’s, Court 21, and Portofino will be applied towards the purchasing member’s annual minimum.
b. Holiday Buffets/Dinners and the Grande Buffet:All Food and Beverage purchased at any Grande Buffets and all Holiday buffets that take place in the Harbourside Dining Room will be applied towards the purchasing member’s annual minimum. The Holiday buffets/dinners are as follows: Easter, Mother’s Day, Thanksgiving, Christmas, Passover/Seder and Hanukkah Dinner.
c. Golf and Tennis Tournament: All Food and Beverage costs included in the price of any tournament will be applied towards the purchasing member’s annual minimum.
d. Member Events: All other Food and Beverage events planned by the Longboat Key Club & Resort are considered Member Events. The costs of these events are not applied towards the purchasing member’s minimum. The reason for this is that they are already offered at a discounted price.
e. All Golf and Tennis Tournaments held since February 1, 2011 will have the Food and Beverage portion of the tournament price applied towards the purchasing member’s minimum.
f. At no time will the taxes, gratuity and/or additional gratuity from any Food and Beverage purchase be applied towards the purchasing member’s minimum.
g. Payment for off-premise catering purchases will apply to the minimum.
X. Waiver of Liability
The Member (which term, for the purposes of this section, shall include all family Members of the Member under 21 years of age residing with the parent(s), see Rules & Regulations, I Membership Rules, Section 9) is aware of and understands the risks of participating in or using the Club facilities: golf courses, golf carts, tennis courts, swimming pool, exercise equipment, dance, stretching and aerobic exercise programs; massage or body treatments.
The Member expressly assumes full responsibility for any and all injuries or damages that may occur to the Member in or about the Club or its premises resulting from these activities and fully releases, discharges, indemnifies and holds harmless the Club (which term, for purposes of this section, shall include Club Owners, employees, agents and assigns) from any and all liability whatsoever for all claims, damages and causes of action arising directly or indirectly from these activities. The Member agrees that the Club shall not be liable to the Member for any damages or loss arising from personal injuries or property damage sustained by the Member in or about the Club or its premises resulting from the use of the facilities.
The Member warrants and represents by acceptance of these Rules & Regulations or otherwise by using the facilities, that the Member is in good physical condition and that the Member has no disability, impairment or ailment that would prevent or make it medically unwise for the Member to engage in the exercise or other activities or services offered by the Club.
